The Mixed Court is a Chinese Court applying
Chinese law to Chinese and non-treaty foreign defendants.
It is for the Mixed Court to determine in each
instance whether any person brought before it is triable by
the Mixed Court or not.
In deciding this point it should be guided by
Chinese law and the treaties made by China with foreign
countries alone.
Under Chinese law a person of Chinese parentage
is a Chinese, even though born abroad, until he has formally
divested himself of his Chinese nationality; and neither
Chinese law nor (so far as I am aware) the treaties admit
the extension of extra-territorial privileges to Chinese.
